Re-Employment of Ex-Servicemen
As per Department of Personnel & Training’s OM No. 36034/27/84-Estt(SCT), dated 2.5.1985, on an Ex-servicemen joining the Government job on civil side after availing of the benefits given to him as an Ex-servicemen for his re-employment, his Ex-servicemen status for the purpose of re-employment in Government would cease. As per DOP&T OM No. 36034/6/90-Estt(SCT), dated 10.10.1994, an ex-servicemen already secured regular employment under the Central Government in a civil post would be permitted the benefits of age relaxation as admissible for ex-servicemen for securing another appointment in any higher post or service under the Central Government. However, such candidates will not be eligible for benefits of reservation, if any, for ex-servicemen in Central Government jobs.
As per DOP&T’s OM No. 36034/1/2014-Estt(Res), dated 14.8.2014 if an ex-serviceman applies for various vacancies before joining any civil employment, he / she can avail of the benefit of reservation as ex-servicemen for any subsequent employment. However, to avail of this benefit, an ex-serviceman as soon as he / she joins any civil employment, should give self-declaration / undertaking to the concerned employer about the date-wise details of application for various vacancies for which he / she had applied for before joining the initial civil employment. This benefit would be available only in respect of vacancies which are filled on direct recruitment and wherever reservation is applicable to the ex-servicemen.
In addition to above, a proposal has been referred to DOP&T to the effect that an Ex-servicemen be allowed the benefit of reservation for second time and even thereafter in subsequent recruitments for civil employment, if the vacancies, which are to be filled on the basis of direct recruitment and where reservation is applicable to Ex-servicemen, has not been filled up with by those Ex-servicemen, who are getting / claiming benefit of reservation for the first time.
The details of reservation available to Ex-servicemen is as under:
(I) In Central Government Ministries / Departments:
(i) 10% Direct recruitment posts upto the level of Assistant Commandant in Central Para Military Forces.
(ii) 10% Direct recruitment posts in Group ‘C’.
(iii) 20% Direct recruitment posts in Group ‘D’.
(II) In Central Public Sector Enterprise:
(i) 14.5% in Group ‘C’ Posts.
(ii) 24.5% in Group ‘D’ Posts.
(III) Nationalised Bank:
(i) 14.5% in Group ‘C’ Posts.
(ii) 24.5% in Group ‘D’ Posts.

ECHS POLICY FOR CHANGE OF POLYCLINIC

1.   As per policy issued vide Central Org ECHS No B/49711/AG/ECHS 25 Mar 2011, it is responsibility of New ECHS polyclinic  to forward an intimation regarding outstation member joining the Polyclinic as permanent members (opting for parent Polyclinic) to previous (old) parent Polyclinic and RC as per format att at Appx ‘A’ to this policy letter.

2.   Some ECHS Polyclinics are pressurise veterans to bring Appx A duly signed from previous (old) parent polyclinic by hand resulted into heavy expenditure to members specially outstate/district. They reassign their responsibility to members by violating the Para 5 (a) to (d) of policy. 

3.   If any violation on policy by ECHS Polyclinic for their  convenient, the matter may please be reported to OIC ECHS/Station HQ.

Guidelines for Pay Fixation of Ex-Servicemen/Ex-ECOs/SSCOs Re-employed in Public Sector Banks on or after 1.1.2006



GUIDELINES FOR PAY FIXATION OF EX-SERVICEMEN/EX-ECOS/SSCOS RE-EMPLOYED IN PUBLIC SECTOR BANKS ON OR AFTER 1.1.2006

Fixation of pay of ex-servicemen in Public Sector Banks is governed by the guidelines/instructions issued by the Government of India from time to time. Accordingly, based on the Government Guidelines/instructions in force, issued vide DoPT 0.M.No.3/19/2009—Estt (pay II) dated the 5th April, 2010 and clarification given vide 0.M.No.3/19/2009—Estt.(Pay-II) dated the 8th November, 2010, fitment of pay of ex-servicemen/ex-ECOs/SSCOs, who have been appointed in the Bank on or after 1.1.2006 is to be done as under:

Pay fixation of an ex-serviceman would be through protection of pay plus D.A. drawn by him at the time of released from Armed Forces. As per the instructions issued by the Ministry of Defence vide their letter No.1/69/2008/D(Pay/Service) dated the 24th July, 2009 and advised by DoPT vide OM No.3/19/2009 — Estt.(Pay II) dated the 8th November, 2010, pre-retirement pay has been defined as under:-

(i)     In respect of re-employment taking place on or after 1.1.2006, pre-retirement pay for those who retired after 1.1.2006, means the pay in the pay band plus grade pay but inclusive of non-practicing Allowance (NPA) if any, last drawn before retirement.

(ii)    In case of officers who retired before 1.1.2006 and also those who retired after 1.1.2006 in the pre-revised pay scales without opting for the revised pay scales promulgated on or after 1.1.2006 the pay will be basic pay including stagnation increment and Rank Pay plus Dearness Pay and Dearness Allowance drawn at the time of retirement. As such, the figure of pay plus D.A. admissible in the Bank will be fixed with reference to this protection i.e. pay as mentioned above plus DA and relevant stage of the basic pay in the re-employed scale will be determined after deducting DA admissible in the Bank from the figure protected. For the purpose of fixation of pay on re-employment, the pay would mean the basic pay plus the special allowance/special pay as the case may be, attached to the re¬employed post.(where applicable). As the MSP has not been included in pre-retirement pay as per the definition given by the Ministry of Defence vide letter No.1/69/2008/D(Pay/Service) dated 24.7.2009, the protection of the component of MSP in re-fixation of pay in Bank has been excluded. Moreover, the ex-servicemen on re-employment in the banks are allowed to draw entire pension i.e. entire pension is ignored and not reduced from the re-fixed pay. As such, they will get the benefit of the component of Military Service Pay (MSP), if any, in their pension from the Government. 



(iii)   In addition to the pay so fixed, as aforesaid, pension and other retirement benefits may be allowed to be drawn. This will, however, be subject to limitation that the aggregate of re-employed pay and pension on re-employment of ex-servicemen would not exceed the minimum of the scale of pay of the General Manager in the Bank as per Ministry of Finance letter No.F4/1/98-SCT(B) dated 2.9.1998.

Ex-Emergency Commissioned Officer/Short Service Commissioned Officer — Joining in Officers Cadre 

Pay of an Ex-ECO/SSCO will be fix'ed at the minimum of the pay scale. Thereafter, he will be allowed as many increments as the completed years of service he has put in the Armed Forces subject to the condition that the total emoluments in the re-employed post do not exceed the total emoluments excluding HRA and CCA he was drawing at the time of his release from the Armed Forces. In case this total exceeds to total emoluments drawn at the time of release from Armed Forces, the basic pay in the re-employed post will be fixed at such a stage, where the total emoluments would be either equal or just less than the total emoluments he was drawing at the time of his release from the Armed Forces. The benefits of pay fixation as mentioned above will be available to those Ex-ECOs/SSCOs who join in Junior Management Grade Scale— I (i.e., the lowest rank in officers' cadre). If the officer is inducted in a higher pay scale as compared to the lower scale applicable to officers in the Bank, it may be ensured that he gets at least the benefit in pay which would have accrued to him by giving him the weightage of the number of years of service put in as ECO/SSCO with reference to the minimum of the lowest scale i.e., JMGS-I.

ECOs/SSCOs during the pre-commissioned training period are neither given the rank of Commissioned Officer nor they are allowed the scale of pay. Therefore, the period spent on pre-commissioned training by ECOs/SSCOs cannot be taken into account for the purpose of pay fixation on their re-employment.

Cadre Ex-Service Officer Joining in Workmen:-

In terms of Ministry of Finance letter No.202/8/7/86-SCT(B) dated the 22 March, 1988, there is no bar to any Ex-Service Officer joining the workmen's cadre in the Bank in which case his pay may be fixed as under:

(i)     In case where the entire pension and pensionary benefits are not ignored for pay fixation, the initial pay on re-employment shall be fixed at the same stage as the last pay drawn before retirement. If there is no such stage in the re employed post, the pay shall be fixed at the stage below that pay. If the maximum of the pay scale in Which a pensioner is re-employed is less than the last pay drawn by Ex-Service Officer before retirement, his initial pay shall be fixed at the maximum of the re-employed post.

(ii)    If the minimum of the scale of pay in which a pensioner is re-employed is more than the last pay drawn by him before retirement, his initial pay shall be fixed at the minimum of the scale of pay at the re-employed post. However, in all these cases, the non ignorable part of the pension and pension equivalent of retirement benefits as prescribed from time to time shall be reduced from the pay so fixed. The pay for this purpose will exclude compensatory allowances e.g., HRA, CCA, etc.

(iii)   Those ECOs/SSCOs who are appointed in clerical cadre in the Bank will also be given the benefit of number of years of service put in by them as ECOs/SSCOs with reference to the pay point corresponding to the minimum of the scale applicable to the clerical cadre/posts in the Bank.

(iv)   Ex-Servicemen who are graduates may be given increments for graduation irrespective of the fact whether they have passed graduation before joining the service of the bank or afterwards. However, if the ex-serviceman had been given some benefit for graduation which was reflected in the pay drawn by him while in the armed services, the fitment in the Bank's scale has to be done after withdrawing such additional benefit and thereafter the two increments for graduation must be given.

(v)    An ex-serviceman whose qualification is treated as equivalent to that of a graduate is not be treated as a graduate to earn the benefit of increments in terms of Awards/Settlements. In other words this benefit will be available to an ex-serviceman only if he has passed civil examination equivalent to graduation.

Subject: Alleged discrimination in the matter of pay fixation of Ex-servicemen re-employed in Public Sector Banks.

Sir,

I am directed to refer to your letter No. HR&IR/KSC/G0VT158917746, dated 27th August, 2013sending therewith 'Draft Guidelines regarding pay fixation of ex-serivicemen/Ex-ECOs/SSCOs in a uniform way to avoid disparity in pay fixation across Public Sector banks and to say that draft guidelines generaOy appear in order.

2. However, before issue of these guidelines to all Public Sector Banks, it is desirable to; ensure that no decision is contradictory to established government policy and that none of these are violative of Department of Personnel & Training (DOP&T) or Ministry of. Defence (MoD) instructions on this subject. Therefore, adding a supporting clause below each decision clarifying- "These provisions have been drawn in terms of Gol, DOP&T's OM/MoD/DFS lefter No  dated  "would be in the fitness of things. For example,-"Definition of 'Pre-retirement Pay' is as per MoD's letter No. 1169/2008/D(Day/Service) dated 24th July, 2009".


3. Further, the fact whether additional increments to ex-servicemen for acquiring graduation would also be available or not to those who are awarded 'Certificate equivalent to Graduation' by their previous employer also needs to be clarified. Proposed revised guidelines should also include a para clarifying the concept of 'not reckoning ‘MSP' and `X-pay' for the purpose of pay fixation in respect of those Ex-servicemen who have retired from the armed forces and re-employees in PSBs on OF after 1.1.2006'.

4. The date; of implementation of these guidelines, prospective or retrospective and the mode of tackling effect of financial implications, if any also needs to be clarified.

5. Keeping in view above suggestions, kindly issue necessary guidelines at the earliest.

Dear Sir,
Pay Fixation of Ex-Servicemen Re-Employed in Public Sector Banks 
We refer to our letter No.HR&IR/CIR/2012-13/76/589/5850 dated 6.9.2012 regarding re-fixation of pay of ex-servicemen re-employed in Banks on or after 1.1.2006.

2. Keeping in view the fact that all the Public Sector Banks are enjoying autonomy in their HR matters, the Ministry of Finance, vide its letter dated 22nd March, 2013, requested IBA to frame uniform guidelines for fixation of pay of Ex-Servicemen upon their re-employment in PSBs, in consonance with the Government of India's policy in the matter and the principle of fairness. The letter further stated that the system of re-employment should be reviewed comprehensively to allow Ex-Servicemen to have their pay protected upon re-employment in PSBs. IBA was requested to have these issues considered and examined in consultation with the PSBs and send their considered opinion/comments to the Ministry of Finance, Department of Financial Services for necessary action.


3. Accordingly, IBA constituted a Working Group, consisting of three senior officers drawn from banks and prepared a report. With the approval of the Managing Committee at its meeting held on 6th June, 2013, the Report of the Working Group was sent to DFS for their consideration and to issue necessary guidelines. The Ministry of Finance, vide letter dated 19th July, 2013, advised IBA to take appropriate decision in the matter of pay fixation of re¬employed Ex-Servicemen in PSBs as deemed fit. While doing so, IBA was asked to ensure that such pay fixation is in consonance with DOPT guidelines issued from time to time that all PSBs follow the guidelines uniformly to avoid disparity in pay fixation across PSBs.

4. As desired by DFS, a "draft" guidelines to be issued to PSBs was sent to the DFS vide our letter dated 27th August, 2013 for their examination and their approval.

5. Now, the Ministry of Finance, DFS, vide their letter dated 30th December, 2013 (copy enclosed), has advised that the draft guidelines prepared by IBA generally appear in order. However, before issue of these guidelines to all PSBs, it is desirable to ensure that no decision is contradictory to established Government Policy and that none of these are violative of DOPT or Ministry of Defence (MOD)/Ministry of Finance instructions on this subject.

6. Draft guidelines, approved by the Ministry of Finance, Department of Financial Services with some suggestions were put up to the Management Committee of IBA at its meeting held on 28.1.2014 for approval. The Committee has approved these guidelines as per annexure enclosed for compliance by Banks.
All the Banks are therefore advised to implement these guidelines regarding pay fixation of ex-servicemen on their re-employment on or after 1.1.2006.

(a) the total number of Ex-servicemen in the country at present, State / UT-wise;

(b) the details of the schemes being implemented for the welfare, resettlement and rehabilitation of the Ex-servicemen in the country; and

(c) whether the Government proposes to provide some more benefits to the Ex-servicemen and if so, the details thereof?

(a) The State / UT-wise number of Ex-servicemen in the country as on December, 2016 is attached as Annexure ‘A’.

(b) The details of scheme being implemented for the resettlement and welfare / rehabilitation of the Ex-servicemen in the country are attached as Annexure ‘B’. In addition to this, Ex-servicemen Contributory Health Scheme (ECHS), a healthcare scheme, has been structured to provide quality medicare to only Ex-servicemen and their dependents of all Tri

Services through a network of its Polyclinics, service hospitals and civil empanelled / Government hospitals spread across the country.

(c) The following measures have been taken to provide more benefits to the Ex-servicemen:

(i) Number of scholarships under Prime Minister Scholarship Scheme has been enhanced from 4000 to 5500 from Academic Year 2015-16.

(ii) Marriage Grant for daughter has been enhanced from Rs.16,000/- to Rs.50,000/- from April, 2016.

(iii) Web portal has been launched by Kendriya Sainik Board on 11th March, 2016 for online process of applications.

(iv) Development of App. Services for beneficiaries of Prime Minister Scholarship Scheme and Raksha Mantri’s Ex-servicemen Welfare Fund.

(v) E-Library facilities for Ex-servicemen and their dependents for reading, search, download and print from any of the E-books.

(vi) Constructed Sainik Rest House at Naraina, Delhi Cantt. for helping boarding / lodging problem of Ex-servicemen / Widows visiting Delhi.

(vii) Grant to Paraplegic Rehabilitation Centre (PRC) Kirkee increased to Rs. 1.20 crore from Rs.0.20 crore.

ANNEXURE ‘B’

I. Details Of various schemes provided by Directorate General Resettlement (DGR):

Resettlement Opportunities : Ex-Servicemen (ESM) are provided re-employment opportunities under the various schemes as mentioned in succeeding paragraphs.

1. Job Opportunities For ESM In Central Government:

(a) In Central Govt Ministries/Departments:

(i) 10% Direct recruitment posts upto the level of Asst Comdt in Central Para Military Force.
(ii) 10% Direct recruitment posts in Group ‘C’.
(iii) 20% Direct recruitment posts in Group ‘D’.

(b) In Central Public Sector Enterprise:

(i) 14.5% in Group ‘C’ Posts.
(ii) 24.5% in Group ‘D’ Posts Including 4.5% for Disabled & Widows

(c) Nationalised Bank:

(i) 14.5% in Group ‘C’ Posts.

2. Placement Assistance through DGR:

Directorate General Resettlement (DGR) sponsors Ex-Servicemen (Officers) to various Government organizations, Public Sector Undertakings, Corporate Houses, Private Sector, Central Para Military Forces etc. based on their requisition for re-employment of ESM.

3. DGR Sponsored Security Scheme:

The DGR empanels / sponsors ESM run Private Security Agencies and State ESM Corporations for providing security guards to various CPSUs, Corporate Houses, Private sector Undertakings etc.

4. Schemes For Officers Only:

(i) ESM Coal Loading and Transportation Scheme: The Scheme is administered on the basis of MoU between the Coal India Ltd (CIL) and DGR.

(ii) Allotment of BPCL/IOCL COCO Outlets Pan India: ESM(Officer) who is registered with DGR and has not availed any other benefit is sponsored for the COCO outlets in the state of choice given by ESM(Officer) based on Oil Company’s requisition.

(iii) Management of CNG Station By ESM (O) In NCR: Desirous ESM (Officers) registered in the scheme are sponsored on receipt of requisition from IGL.

5. Schemes for JCOs/OR Only:

(i) Allotment of Mother Dairy Milk Booths and Fruit & Vegetable (Safal) Shops In NCR: The ESM register for Milk / SAFAL (Fruit and Vegetable booths separately and give multiple choice of zones for the purpose of areas where booths are required.

6. Schemes for All:

(i) Coal Tipper Attachment Scheme: This scheme is linked with the ESM Coal loading and transportation scheme.

(ii) Tipper attachment Scheme for War Widows and Disabled Soldiers :
War widows upto age of 65 and disabled soldiers having 50% or more disability are also allowed to enrol for this scheme.

(iii) Allotment of Army Surplus Vehicles: ESM, widows and Ex-Servicemen Co-operative societies are eligible to apply for allotment of Army Surplus Class V-B Vehicles.

(iv) Allotment of Regular LPG Distributor Ship:
War widows/dependents of those who died in war, war disabled/disabled on duty while serving in operational area, widows/dependents of those who died in harness due to attributable or aggravated causes to Military Service and ex-servicemen disabled in peace due to attributable or aggravated causes to Military Service are eligible.

(v) LPG Agency Under Rajiv Gandhi Gramin LPG Vitrak (RGGLV) Scheme : War widows/dependents of those who died in war, war disabled/disabled on duty while serving in operational area, widows/dependents of those who died in harness due to attributable or aggravated causes to Military Service and ex-servicemen disabled in peace due to attributable or aggravated causes to Military Service are eligible.

(v) Retail Outlet Dealership (Petrol/Diesel): War widows/dependents of those who died in war, war disabled/disabled on duty while serving in operational area, widows/dependents of those who died in harness due to attributable or aggravated causes to Military Service and ex-servicemen disabled in peace due to attributable or aggravated causes to Military Service are eligible.

7. Training:

(i) Officers’ Training :– DGR imparts Resettlement training to the retiring officer /Ex-Servicemen (Officer) in various institutes Pan India.

(ii) JCOs/OR and Equivalents’ Training at Institutes:- DGR imparts Resettlement training to the retiring JCOs/OR /Ex-Servicemen (JCOs/OR) in various institutes Pan India.

1. Modified Scooter Grant: Rupees 57,500/- provides to those ESM, who are disabled after service with a disability of 50% or more and who are not covered under the scheme of AG’s Branch of IHQ (Army, Navy & Air Force).
2. Tool Kit of Ex-servicemen Technicians: Tool Kits are provided at a cost not exceeding Rs. 8,000/- subject to fulfilling the following conditions :-
(a) The individual holds the qualifications to utilize the tool kits.
(b) The individual has the appropriate infrastructure to set up for himself the proposed trade.

3. Serious diseases Grant from AFFD Fund to Non Pensioners ESM of all Ranks:-

(a)
Serious Diseases as listed below: -
Angioplasty, Angiography, CABG, Open Heart Surgery, Valve Replacement, Pacemaker Implant, Renal Implant, Prostate Surgery, Joint Replacement and Cerebral Stoke.
Other Diseases : Where more than Rs 1.00 Lac has been spent on treatment

5. Financial support to States for ESM welfare :- 

(a) Special category States: 75% of the expenditure on establishment of Rajya Sainik Boards/Zila Sainik Boards is shared by the Centre to the special category States i.e Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim, Uttarakhand, Jammu & Kashmir and Himachal Pradesh.

(b) Balance States: 60% of the expenditure on establishment of RSBs/ZSBs is shared by the Centre to the balance of the States.

6. Prime Minister’s Scholarship Scheme: For financially supporting degree 
level professional education for the wards of War widows (all ranks) and ESM (PBOR) including ex Coast Guard personnel. Total 5500 scholarship are provided to eligible wards based on merit for the entire duration of the courses. Priority is given to the wards of War widows/War disabled Soldiers. The rates of Scholarship are as follows :

(a) Rs. 2000/- per month for boys.
(b) Rs. 2250/- per month for girls.

8. Reservation of seats in Medical/Dental Colleges for wards of Defence Personnel as Govt of India Nominee : A total of 17-20 MBBS seats and 1-3 seats in BDS courses are allotted by Ministry of Health Family Welfare to KSB for wards of defence personnel as a Govt. of India nominee.

9. Children Education Concession: Wards of Armed forces personnel killed/ missing/ permanently disabled in action are granted Educational concession.

10. Rail Concession: The Chakra Series Gallantry Awardees and Widows of defence personnel are granted Rail Concessions.

11. Air Travel Concession: Recipients of Level-I and II Gallantry Awards, Pre Independence Awards Level-I and II, War disabled officers (1962, 1965, 1971 conflicts and OP Vijay) and war widows of Indian Armed Forces personnel killed in action are eligible for Air Travel Concession.
